Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Feedback Hub’s websites, QR flows, AI-driven guest messaging, admin dashboards, APIs, and related services (collectively, the “Services”). By accessing or using the Services you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility & Accounts

You must be at least 18 years old and legally able to enter contracts to create an operator account. You are responsible for safeguarding login credentials, configuring venue settings, and ensuring that any team members who access the dashboard comply with these Terms.

2. Services Overview

Feedback Hub provides QR codes, landing pages, AI chat, ticket routing, and analytics to help you collect and act on guest sentiment. We may update or improve features at any time. Certain beta features (such as AI-generated replies) are provided “as is” and may change without notice.

3. Subscriptions & Billing

Access to premium features may require a paid subscription or usage-based fees. Unless otherwise stated in an order form, subscriptions auto-renew for the same term and price. You authorize us to charge the payment method on file for recurring fees, applicable taxes, and overages. Late payments may result in suspension of Services.

4. Guest Feedback Content

Guests may submit ratings, messages, photos, or other content (“Guest Content”). Operators control how Guest Content is used inside their venue workspace. By using the Services you grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Guest Content solely to provide and improve the Services. You represent that you have obtained all permissions necessary to share Guest Content with us.

5. Acceptable Use

You agree not to misuse the Services, including by: (a) violating laws or venue policies; (b) uploading malicious code; (c) interfering with our infrastructure; (d) attempting to re-identify anonymized data; (e) using automated scripts to spam guests; or (f) impersonating others. We may suspend or terminate accounts that violate this section.

6. Venue Responsibilities

Operators must configure escalation rules, staff notifications, and voucher promises to reflect real-world policies. You are solely responsible for honoring commitments you make through the platform, monitoring AI replies, and complying with labor, privacy, and consumer protection laws in the regions where you operate.

7. Google & Third-Party Integrations

If you connect Google Business Profile, Gmail, or other third-party accounts, you authorize us to access and use data as permitted by those providers and described in our Privacy Policy. You may revoke access at any time. We are not responsible for third-party services, and your use of them is subject to their own terms.

8. Intellectual Property

Feedback Hub retains all rights, title, and interest in the Services, including software, branding, and documentation. Except for the limited rights expressly granted, no license is conveyed. You may not reverse engineer, copy, or create derivative works from the Services.

9. Confidentiality

Each party may receive confidential information from the other. You agree to protect our confidential information (including product roadmaps, security practices, and pricing) and use it only to exercise your rights under these Terms.

10. Disclaimer & Limitation of Liability

The Services are provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, Feedback Hub’s liability arising out of or relating to the Services is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, exemplary, or punitive damages.

11. Indemnification

You will indemnify and hold harmless Feedback Hub and its affiliates from claims, damages, liabilities, and expenses arising out of Guest Content, your misuse of the Services, or violations of these Terms.

12. Termination

You may stop using the Services at any time. We may suspend or terminate the Services or your account if you violate these Terms, fail to pay fees, or create security risks. Upon termination we may delete or export stored data subject to legal obligations.

13. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles, and disputes will be resolved in the competent courts of Amsterdam unless another venue is agreed in writing.

14. Changes

We may update these Terms to reflect product changes or legal requirements. We will post updates with a new “Last updated” date and, when material, provide additional notice. Continued use after changes become effective constitutes acceptance.
